Brooklyn Weapon Charge Attorney

Aggressive Defense Against Weapon Charges in New York

New York has some of the strictest weapons laws in the country. Gun and weapon laws in New York fall under New York Penal Law Article 265. An arrest and criminal charge about these laws in any five boroughs can lead to long-lasting and severe consequences. Depending on the charge, you could face jail or prison time, fines, probation, and loss of a professional license or immigration status. A permanent criminal record after a conviction can make employment, housing, and advanced education difficult.

To fight back, you need to challenge the criminal charge; this will require the help of an experienced criminal defense lawyer who can put into place an aggressive defense on your behalf. At Mottola Uris Law, PLLC, our Brooklyn weapon charge lawyers understand state and local weapon laws and how to fight the legality of weapons charges in court. We can thoroughly investigate every aspect of your arrest and consequent charges to determine the best defensive approach to achieve a positive outcome.

Weapon Charges in New York

Charges involving weapons can include a variety of crimes including criminal possession of both deadly weapons and “dangerous instruments.”

Weapons of these kinds can include but are not limited to:

  • Firearms
  • Switchblades
  • Daggers
  • Plastic or metal knuckles
  • Blackjacks
  • Machine guns

Weapon charges can include both misdemeanors and felonies, depending on the circumstances. Criminal possession of a weapon can be charged in the fourth-degree, third-degree, second-degree, and first-degree. Other charges include possession of a firearm or rapid-fire modification device and criminal possession of a weapon on school grounds. Certain weapons, such as machine guns and short-barreled shotguns or rifles, are illegal. The state of New York requires licenses for firearms. However, New York City has passed local gun laws that do not automatically recognize state laws.

New York’s complicated gun laws can carry penalties of up to a year in jail and/or fines of up to $1,000, as well as felonies carrying up to 25 years in prison. For example, if you are convicted of possessing a weapon on school grounds, you can face up to four years in prison.
