What Are the Penalties for Violent Felonies in NY?

In New York, prison sentences imposed for violent felonies are either indeterminate or determinate. 

The most serious felonies are categorized as Class A felonies, charged to such crimes as:

  • Murder
  • Arson
  • Or terrorism

Convictions for these may lead to life in prison without the possibility of parole. Indeterminate sentences provide a range of years for incarceration, such as a minimum of one year up to a maximum of four years. In these cases, once you have served out the minimum, you become eligible for parole. 

When denied parole, your time in prison will be limited by the maximum term. Determinate sentences have a defined amount of incarceration time that doesn’t change. Certain violent felony convictions in New York are subject to determinate sentences followed by a term of probation.
